Construction Workers Injured On The Job Are Protected By New York Law

Working construction in New York can certainly be a dangerous line of work. Construction accidents that occur at construction sites can happen suddenly and without warning. Studies show that construction workers make up about 27% of all work-related deaths in New York City. These tragedies increase during a boom in construction activity and developments, as more workers are employed at construction sites throughout the area.

Every year, hundreds, if not thousands, of workers suffer severe and catastrophic injuries that have a substantial effect on them and their families.

Fortunately, New York's Labor Law, also known as the Scaffold Law, protects construction workers and provides that employers and property owners are fully liable when a worker is injured due to a gravity-related fall while working at high elevations without proper safety equipment. New York law also provides protection to workers injured in other types of accidents, including crane accidents, heavy machinery accidents, crushing accidents, falling objects, and electrocution.

Some types of accidents that could occur at a construction site include:

  • Scaffolding accidents
  • Explosions
  • Electrocution
  • Crane accidents
  • Forklift accidents
  • Defective or malfunctioning work equipment
  • Falls from ladders, roofs, man lifts or pump jacks
  • Falling objects
  • Excavation accidents
  • Demolition accidents
  • Fires

There are a variety of parties who may be liable for a construction worker's injuries suffered during a construction accident. Parties who are commonly found to be liable for worker site injuries include: the Site owner, Developer, Management companies, General contractor, Subcontractors, Manufacturer of faulty equipment or tools, or Manufacturer of defective safety equipment. In many instances, employers or contractors are not fully aware of the safety requirements or simply choose profits over safety.

All negligent parties may be held strictly liable for your injuries. New York laws provide significant protections to injured construction workers so that they are fully compensated for their injuries and can take care of their families financially. Hunt & Associates will fully investigate the circumstances surrounding your accident and discover all of the negligent and potentially responsible parties. Whichever type of construction accident you were involved in and whichever type of injury you sustained, we are ready to help you recover for your medical bills, lost wages and other significant damages. You can sleep soundly knowing that your family is taken care of despite the incredibly difficult times you are facing.
